Orange County couple blames retail negligence for wife's injuries

ORLANDO — An Orange County couple is suing Orlando retail store operators, alleging negligence led to injuries for the wife.

Cairin R. Ustler and Frank Thomas Ustler filed a complaint Oct. 16 in Orange County Circuit Court against Forbes Taubman Orlando and The Forbes Company, doing business as The Mall at Millenia, alleging failureto to maintain its premises in a reasonably safe condition.

According to the complaint, on Oct. 3, 2013, the Ustlers were lawful business customers at the defendants' mall at 4200 Conroy Road, Orlando. While exiting the property, Cairin Ustler slipped and fell on a sloped painted surface directly in front of the ingress. 

As a result, the suit says, she suffered bodily injuries, resulting in physical impairment, mental anguish and loss of ability to earn money. Her husband, Thomas Ustler, says he suffered loss of services, companionship and consortium of his wife. 

The plaintiffs allege the defendants failed to correct the dangerous condition that existed on the premises and failed to warn business invitees that the premises had become slippery when wet.

The Ustlers seek trial by jury, damages in excess of $15,000 and court costs. They are represented by attorney Jeffrey A. Miller of SeifertMiller LLC in Orlando.
