ORLANDO — An Orlando property owner is suing an insurance company, alleging breach of contract regarding water damage to his home.
Phillippe Celcis filed a complaint Oct. 17 in Orange Circuit Court against St. Johns Insurance Company Inc., alleging the defendant breached its duty of good faith and fair dealing.
According to the complaint, on Dec. 3, 2016, Celcis' property at 2849 Silver Ridge Drive, Orlando, was damaged directly and/or indirectly by water due to a broken and/or leaking pipe. The suit says the damages required necessary repairs and replacements, as well as appropriate cleaning and other remedial measures. However, Celicis says St. Johns has refused to provide coverage for the loss.
The plaintiff alleges St. Johns Insurance failed to establish it had reasonable proof that it was not responsible for the payment of Celcis' damages, failed to pay the requested amounts for repairs and/or replacements, and caused the plaintiff to retain and pay for legal counsel.
Celcis seeks trial by jury, damages of more than $15,000, interest, attorney fees, court costs, and all other relief the court deems just. He is represented by attorney Thomas J. Morgan Jr. of Morgan Law Group PA in Coral Gables.
