Homeowner alleges insurance carrier failed to pay for damages

ORLANDO — An Orlando homeowner is suing an insurance carrier, alleging breach of contract in failing to pay for damages.

Jorge Moreno filed a complaint Oct. 17 in Orange Circuit Court against Universal Property & Casualty Insurance Company, alleging breach of good faith and fair dealing.

According to the complaint, on Oct. 7, 2016, Moreno's insured property at 1018 Apopka Woods Lane, Orlando, sustained damages caused by a covered peril. The suit says although Universal Property acknowledged receipt for the loss and assigned an insurance adjuster, it subsequently rejected the total amount of $15,974.17 in damages and completely denied coverage. 

The plaintiff alleges Universal Property & Casualty refused to honor its contractual obligations to protect Moreno's assets and to pay for the covered loss.

Moreno seeks trial by jury, judgment of more than $15,000, plus court costs, prejudgment interest and attorney fees. He is represented by attorneys Jonathan Drake and Manuel L. Iravedra of Strems Law Firm in Coral Gables.
