Customer blames Wal-Mart for fall, injuries

ORLANDO — A customer is suing Wal-Mart, alleging negligence caused the plaintiff to suffer injuries.

Elba Gonzalez filed a complaint Oct. 16 in Orange County Circuit Court against Wal-Mart Stores East, alleging the retail store operator failed to maintain its premises in a reasonably safe condition.

According to the complaint, on June 8, 2014, Gonzalez was at the Wal-Mart, 3838 S. Semoran Blvd., Orlando, when she tripped and fell over a raised rug near the store entrance. As a result, the suit says, she suffered bodily injuries and resulting pain and suffering, disability, mental anguish and incurred medical and treatment expenses. 

The plaintiff alleges Wal-Mart Stores East negligently allowed an unsafe condition to exist on the premises and failed to warn customers of the dangerous condition.

The plaintiff seeks trial by jury, damages of at least $15,000 and costs of court. She is represented by attorney Juan Ascponape of Schwed, Adams, Sobel & McGinley, PA in Palm Beach Gardens.
