Mother accuses hospital, staff of medical negligence

CLEARWATER — A mother and her child are suing a St. Petersburg hospital and its staff, alleging medical negligence.

Janisha Hayes, individually and next guardian and natural parent of MKS, filed a complaint Oct. 18 in Pinellas County Circuit Court against Bayfront HMA Medical Center, Bayfront HMA Physician Management, Dr. Olubukola Ayeni,  Dr. Rachelle Schwartz, Dr. Lauren Davis, Dr. Martin Castaneda, and Dr. Stephanie Jean-Baptiste, alleging they failed to use reasonable care in providing medical services to their patients.

According to the complaint, as a result of the negligent bungling of the delivery process Nov. 15-17, 2016, Hayes suffered bodily injuries at Bayfront HMA Medical Center, resulting in pain and suffering, medical, hospital and treatment expenses and aggravation of a pre-existing condition. The suit says her newborn child suffered permanent debilitating injuries and a fractured collarbone. 

The plaintiffs allege the defendants failed to assess the baby's fetal size and weight to ensure proper delivery, failed to properly communicate with health care providers and failed to offer an option for cesarean section.

Hayes and her child seek trial by jury, compensatory damages of at least $15,000, taxable costs, prejudgment interest and all other relief the court deems just. They are represented by attorney Charles T. Moore of Morgan & Morgan Tampa PA in St. Petersburg.
