Couple accuses Hyundai of breach of written warranty

CLEARWATER — A Florida couple is suing Hyundai, alleging breach of warranty.

Donald Stuart Wiessner and Donna Marie Wiessner filed a complaint Oct. 17 in Pinellas County Circuit Court against Hyundai Motor America Corporation, alleging the manufacturer obtained profit through unfair or deceptive trade or commerce.

According to the complaint, on Dec. 22, 2012, Donald Wiessner and Donna Wiessner began suffering financial damages from having purchased a Huyndai Santa Fe for $26,809 from the defendant. The suit says Hyundai failed to adequately repair the defects of the vehicle despite at least three attempts. 

The plaintiffs allege Hyundai Motor America failed to repair the Santa Fe vehicle within a reasonable time, failed to adequately repair the defects in the vehicle and caused diminution on the value of the vehicle.

The Weissners seek trial by jury, incidental and consequential damages, attorney fees, witness fees, court costs, and all further relief the court deems just. They are represented by attorney Brent Wikgren of Krohn & Moss Ltd. in Chicago.
