CLEARWATER — An insurance firm is suing a motorist, alleging his negligence caused a crash.
Citizens Property Insurance Corporation as subrogee of George Spencer, filed a complaint Oct. 17 in Pinellas County Circuit Court against Brandy Hardin Bourehla, alleging the motorist failed to exercise standard care and skill required in operating a vehicle.
According to the complaint, on Jan. 7,Spencer, sustained damages to his property as a result of reckless vehicle operation by Bourehla. The suit says Bourehla's vehicle collided with a parked car in Pinellas County, which caused the parked car to hit Spencer's property. As a result of the defendant's negligence, the suit states, Citizens Property was obligated to pay insurance coverage of $33,194.92 for damages to the property.
The plaintiff alleges Bourehla failed to safely operate a vehicle so as not to cause damage, obligated Citizens Property to fully compensate Spencer's claim under the policy and forced the plaintiff to retain and pay for the services of a legal counsel.
Citizens Property seeks trial by jury, judgment of $33,194.92, along with the costs of action and prejudgment interest. It is represented by attorney William F. McFetridge of Gray/Robinson PA in Tampa.
