Customer blames restaurant for injuries

ORLANDO — A Polk County woman is suing an Orange County restaurant, alleging failure to remove a hazardous condition inside the premises.

Lillian Asencio filed a complaint Oct. 9 in Orange County Circuit Court against BJ's Restaurants Inc., alleging the defendant failed to exercise reasonable care for the safety of individuals inside the premises.

According to the complaint, on May 12, 2015, Asencio was a guest on the premises of BJ's in Orlando. The suit says she slipped and fell due to a wet or slick substance on the floor near the bathroom within the restaurant. As a result, the suit says, Asencio suffered physical injuries, loss of earnings and incurred medical expenses. 

The plaintiff alleges BJ's Restaurants failed to inspect and adequately warn of the danger of the premises and failed to correct the unreasonably dangerous condition. 

Asencio seeks trial by jury, damages of at least $15,000, and all other relief the court deems just and proper. She is represented by attorneys Carolyn M. Salzmann, Billie Jo Belcher and Leia V. Leitner of Legally Pink Law PLLC in Winter Park.
