Customer blames injuries on theater owner's negligence

ORLANDO — A Polk County man is suing Cinemark, alleging negligence caused him injuries at an Orlando movie theater.

Michael Rutkowski of Davenport, Florida, filed a complaint Oct. 10 in Orange Circuit Court against Cinemark USA Inc., alleging the movie theater owner failed to follow applicable safety guidelines and regulations.

According to the complaint, on Jan. 28,  Rutkowski was lawfully on Cinemark property at 5150 International Drive, Orlando, as a customer. The suit says Rutkowski slipped on a transitory substance on the floor and fell to the ground.

Rutkowski says he sustained severe bodily injury, disability, disfigurement, scarring, mental anguish, loss of earnings, and aggravation of previous existing conditions. 

The plaintiff alleges Cinemark USA failed to warn him of the danger of the transitory substance on the floor, and failed to inspect, maintain and/or correct the dangerous condition.

Rutkowski seeks trial by jury, damages in excess of $15,000, plus interest and court costs. He is represented by attorney Steven J. Tomesko of Dan Newlin & Partners in Orlando.
