Patient accuses medical providers of negligence

CLEARWATER — A patient is suing medical providers, alleging negligence caused him pain and suffering.

James R. Butterfield filed a complaint Sept. 27 in Pinellas County Circuit Court against Conforti Chriropractic and Wellness Center Inc. and Ryan A. Smith DC, alleging they failed to exercise standard care and skill required of medical providers.

According to the complaint, Butterfield suffered significant and permanent loss of an important bodily function, disability, disfigurement, mental anguish and aggravation of a previously existing condition, as a result of the defendants' negligent care and treatment after he fell at an ice skating rink June 7, 2015. 

The plaintiff alleges the defendants failed to review Butterfield's past records from previous physicians, failed to perform physical and neurological examination in light of significant deterioration in the patient’s condition, and failed to appropriately revise the diagnosis.

Butterfield seeks trial by jury, judgment of more than $15,000, plus costs and interest. He is represented by attorney Mark H. Perenich of Perenich, Caulfield, Avril & Noyes PA in Clearwater.
