FORT LAUDERDALE — A Boynton Beach property owner is suing an insurance company, alleging breach of contract.
Deplhine Hamon filed a complaint Oct. 6 in Broward County Circuit Court against Homeowner's Choice Property & Casualty Insurance Company Inc., alleging the defendant breached its duty of good faith and fair dealing.
According to the complaint, on Feb. 8, while the Homeowner's Choice insurance policy was in full force and effect, Haron suffered losses at her 2130 N. Seacrest Blvd. property due to a sudden and accidental discharge of water caused by a failure in the bathroom plumbing.
However, the suit says, Hamon has not received the full benefits under the policy. The plaintiff alleges Homeowner's Choice Property & Casualty has failed and refuses to fully pay the damages covered by the policy.
Hamon seeks trial by jury, damages of more than $15,000, interest, court costs, attorney fees and any further relief the court deems just and appropriate. She is represented by attorney Erika L. Pardo of The Pardo Law Firm PA in Coral Gables.
