ORLANDO — An Orlando property owner is suing an insurance company, alleging breach of an insurance contract.
Fernando Leano filed a complaint Sept. 29 in Orange County Circuit Court against Heritage Property & Casualty Insurance Company, alleging the defendant breached its duty of good faith and fair dealing.
According to the complaint, on May 16, Leano's insured property at 3759 Rambling Rose Court, Orlando, sustained water damage due to an opening in the roofing system caused by a covered peril.
To date, the suit says, the damage to the property has not been repaired or replaced. The plaintiff alleges Heritage has refused to pay the requested amount for repairs and failed to establish that it had proof that Heritage was not responsible for payment.
Leano seeks trial by jury, damages between $5,000 and $15,000, interest, attorney fees, court costs and all other relief the court deems just and proper. He is represented by attorney Thomas J. Morgan Jr. of Morgan Law Group, PA in Coral Gables.
