Employee alleges restaurant violated federal wage laws

ORLANDO — A Pensacola man is suing an Orange County restaurant, alleging violation of applicable minimum wage law and violation of workers compensation acts, including the Fair Labor Standards Act.

Christopher Zisa filed a complaint Sept. 28 in Orange Circuit Court against Indian Hot Orlando LLC, doing business as Indian Hut, alleging the restaurant failed to provide employees proper wages, benefits and incentives.

According to the complaint, Zisa worked for Indian Hut as a dishwasher, cook, server, cleaner and food busser from June 14, 2015, Jan. 31, 2016. The suit says Zisa suffered economic harm from Indian Hut's wrongful business practice of not paying the required legal minimum and overtime wages. 

The plaintiff alleges Indian Hut compensated Zisa well below the applicable Florida minimum wage of $8.05 per hour, violated the guidelines for proper tip pooling, and failed to compensate plaintiff the applicable overtime wage when Zisa worked more than 40 hours per week..

Zisa seeks trial by jury, damages of more than $15,000, declaration of violations, liquidated damages, interest, attorney fees, court costs, disbursements and all further relief the court deems just and proper. He is represented by attorney Kevin E Vorhis of Cohen Law Group in Maitland.
