Policy holder alleges insurer failed to cover water damage

ORLANDO — An Orlando woman is suing an insurance company, alleging breach of contract.

Dilia Masson filed a complaint Sept. 20 in Orange County Circuit Court against Southern Fidelity Insurance Company, alleging the insurance carrier failed to cover water damage, breaching its duty of good faith and fair dealing.

According to the complaint, on Jan. 24, 2016, Masson's property at 12108 Blackheath Circle, Orlando, was damaged directly and/or indirectly by water due to a broken and/or leaking pipe in the kitchen. As a result, Masson said she sustained damages to the property that required necessary repairs and replacements, as well as appropriate cleaning and other remedial measures. However, the suit says, Southern Fidelity denied coverage of the loss. 

The plaintiff alleges Southern Fidelity Insurance failed to establish proof that it was not responsible for the payment of Masson's damages and/or loss, and failed to pay the requested amounts to repair plaintiff's property to its pre-loss condition.

The plaintiff seeks trial by jury, damages of more than $15,000, interest, attorney fees, court costs, and all other relief the court deems proper. She is represented by Thomas J. Morgan Jr. of Morgan Law Group PA in Coral Gables.
