Orange County homeowners allege insurance carrier failed to cover damage

ORLANDO — Two Orange County homeowners are suing an insurance carrier, alleging breach of contract.

Yanara Pena Cuesta and Victor Jiminez filed a complaint Sept. 20 in Orange County Circuit Court against Security First Insurance Company, alleging breach duty of good faith and fair dealing in failing to cover damages to an insured property.

According to the complaint, while the plaintiffs' insurance policy was in full force and effect, their property at 7619 Coot St., Orlando, sustained a covered loss. As a result, the plaintiffs allege they have suffered and continue to suffer damages resulting from Security First's breach of the policy by failing to tender an appropriate amount to repair the Orlando  property. 

The plaintiffs allege Security First Insurance Company failed to adequately indemnify the plaintiffs for the loss, and obligated the plaintiffs to pay for the services of a legal counsel to represent and protect their interests.

Cuesta and Jimenez seek trial by jury, damages of more than $15,000, plus interest, court costs and attorney fees. They are represented by attorneys Louis A. Gonzalez and Zaf Glenn Goss of Trujillo Vargas Gonzalez & Hevia LLP in Orlando.
