Family blames Pinellas County hospital, staff for woman's death

CLEARWATER — A personal representative of an estate is suing a Pinellas County hospital and staff, alleging negligence and vicarious liability in the death of a relative.

Helaine Roberts filed a complaint Sept. 15 in Pinellas Circuit Court against James Adams, Jannifer M. Akers, Richard A. Clem, St. Anthony's Hospital Inc., et al., alleging they failed to exercise standard care and skill required of medical providers and facilities.

According to the complaint, Cynthia Moore was treated for respiratory problems at St. Anthony's Hospital between September-October 2015. The suit says on June 3, 2017, Moore died, due to respiratory arrest caused by an airway impairment related to her damaged trachea. The lawsuit states this complication was brought about by the negligence of the defendants in the care and treatment of Moore. 

The plaintiff alleges the defendants failed to properly measure and document Moore's endotracheal cuff pressures, and failed to provide adequate respiratory therapy care, treatment and services.

Roberts seeks trial by jury, survival damages of more than $15,000, courts costs and all other relief allowed by Florida law. She is represented by attorney Lee D. Gunn IV of Gunn Law Group PA in Tampa.
