Customer blames Winter Park restaurant's negligence for injuries

Slip01

ORLANDO — A Winter Park woman is suing a local restaurant, alleging negligence caused her injuries.

Yvette Otero filed a complaint Sept. 6 in Orange County Circuit Court against Miller's Ale House Inc., alleging the property owner failed to use ordinary care to maintain its premises in a safe condition.

According to the complaint, on Aug. 4, 2015, Otero was a customer at Miller's Ale House on Lee Road, Winter Park, when she slipped and fell on a transitory liquid on the floor of the restaurant. As a result of the defendant's negligence, Otero said she sustained bodily injury and resulting pain and suffering, disability, disfigurement, mental anguish, incurred medical expenses, loss of earnings and aggravation of a previous existing condition.

The plaintiff alleges Miller's Ale House allowed liquid to accumulate on the floor, failed to maintain its floor in a safe condition, and failed to warn Otero of the hazardous condition.

Otero seeks trial by jury, damages in excess of $15,000, plus court costs. She is represented by attorney Matthew A. Rabin of Reifkin Thompson & Rudzinski LLP in Kissimmee.
