ORLANDO — A property owner is suing tenants ELR Restoration Inc. and Eric L. Rosario for alleged breach of contract.
ASA LLLP filed a complaint on July 20 in the Orange County Circuit Court, alleging that the defendants breached their duty of good faith and fair dealing.
According to the complaint, the plaintiff alleges that it has suffered financial damages as a result of the defendants failing to pay rent and for allegedly vacating rented property in damaged conditions.
The plaintiff holds the defendants responsible for allegedly failing to pay rent and amounts due, removing fixtures in the rental property without the plaintiff's written approval and daming the vacated premises and building.
The plaintiff requests a trial by jury and seeks judgment against the defendants for damages in the amount of $295,489.46, interest, attorney's fees, costs and other relief the court finds just. They are represented by Jason O'Neal of Cornerstone Law Firm PLLC in Casselberry.
