Citizens Property Insurance Corporation accused of breaching insurance contract

FORT LAUDERDALE — Two individuals are suing Citizens Property Insurance Corporation for alleged breach of contract.

Daniel and Barbara Herz filed a complaint on July 24 in the Broward County Circuit Court, alleging that the defendant breached its duty of good faith and fair dealing.

According to the complaint, the plaintiffs allege that they suffered damages to their property and its contents on Oct. 21, 2016 due to a water leak. However, the defendant alleged denied coverage and refused to pay any amount of the claim. 

The plaintiffs hold the defendant responsible for allegedly breaching its insurance contract by not compensating the plaintiffs for the damages, and for allegedly forcing the plaintiffs to retain and pay for an attorney.

The plaintiffs request a trial by jury and seek judgment against the defendant for damages, interest, attorney's fees, costs and other relief the court deems just. They are represented by Erik D. Diener of the Diener Firm PA in Plantation.
