Prepared Insurance Company accused of violating insurance contract

FORT LAUDERDALE — An individual is suing Prepared Insurance Company for alleged breach of contract.

Dana Doklean filed a complaint on July 24 in the Broward County Circuit Court, alleging that the insurance carrier breached its duty of good faith and fair dealing.

According to the complaint, the plaintiff alleges that her property was damaged on March 25 due to a water leak. However, the defendant allegedly has refused to pay for the damages despite the plaintiff's allegedly filing a timely claim. 

The plaintiff holds the defendant responsible for allegedly obligating her to retain and pay for legal counsel to represent and protect her interests, and for allegedly refusing to pay the full amount of her insurance claim.

The plaintiff requests a trial by jury and seeks judgment against the defendant for actual and compensatory damages, pre-judgment interest, costs of action, attorney's fees and further relief the court may deem appropriate. She is represented by Andrew P. McDonald and David D. Barnhill of McDonald & Barnhill PA in Tampa.
