ORLANDO — A homeowner is suing Universal Property & Casualty Insurance Company for alleged breach of contract.
Yves Sincler filed a complaint on June 27 in the Orange County Circuit Court, alleging that the defendant breached its duty of good faith and fair dealing.
According to the complaint, the plaintiff alleges that he suffered covered losses on Sept. 24, 2015 caused, in part, by sudden and accidental discharge of water from a plumbing vessel. The plaintiff allegedly filed a claim and allegedly was assigned a claim number, but the defendant allegedly has not paid the plaintiff the full amount of loss.
The plaintiff holds the defendant responsible for allegedly failing to investigate and adjust the full scope of the plaintiff’s covered loss and damage, acknowledge coverage for all of the plaintiff’s covered loss and fully pay the insurance benefits due.
The plaintiff requests a trial by jury and seeks judgment against the defendant for damages, including consequential damages, attorney’s fees, pre-judgment interest, costs and further relief as the court deems just. He is represented by Jonathan Korin of Korin Law PA in Miami.
