ORLANDO — A married couple is suing State Farm Florida Insurance Company for alleged breach of contract.
Marvin and Mary M. Scott filed a complaint on June 27 in the Orange County Circuit Court, alleging that the defendant breached its duty of good faith and fair dealing.
According to the complaint, the plaintiffs allege that their property suffered direct, physical damage on July 19, 2013 caused by wind damage to their house’s exterior. The defendant, however, allegedly denied coverage for the damage.
The plaintiffs hold the defendant responsible for allegedly refusing to pay amounts due under the policy, and for allegedly required the plaintiffs to retain and pay for legal counsel to represent and protect their interests.
The plaintiffs request a trial by jury and seek judgment for damages against the defendant, including interest, costs, attorney’s fees and all equitable remedies or other relief that may be appropriate. They are represented by Tracey Foglia of Florida Professional Law Group PLLC in Hollywood.
