City of Orlando accused of negligence

ORLANDO — A Florida resident is suing the City of Orlando for alleged negligence.

Jack Kaleita filed a complaint on June 22 in the Orange Circuit Court, alleging that the defendant failed to provide a safe environment for its patrons.

According to the complaint, the plaintiff alleges that he was visiting a city-owned park on June 20, 2015 when he fell to the ground and sustained injuries due to sitting on a defective picnic table/bench. The plaintiff alleges that he sustained pain and suffering, disability, disfigurement, scarring, mental anguish and loss of earnings. 

The plaintiff holds the defendant responsible for allegedly failing to maintain the benches/tables on the property or inspect or warn the plaintiff of the danger of the damaged benches/tables.

The plaintiff requests a trial by jury and seeks judgment against defendant for damages in excess of $15,000 plus interest and costs. He is represented by Michael J. Smith of Morgan & Morgan PA in Tavares.
