ORLANDO — A customer is suing CVS Health and an unknown employee for alleged intentional infliction of emotional distress and false imprisonment.
Fanny Yesenia Mactavish filed a complaint on June 22, in the Orange County Circuit Court, alleging that defendants locked her inside a CVS store.
According to the complaint, the plaintiff alleges that she was in defendants' store to shop on April 26 when she realized that no one was present and the store had closed. As a result, plaintiff suffered mental anguish and other damages from the alarm that she set off and for being detained by police officers for questioning.
The plaintiff holds the defendants responsible for allegedly failing to ensure closing procedures were properly followed and warn customers of the store's closure and for causing her unlawful detention.
The plaintiff requests a trial by jury and seeks judgment against defendants for damages, costs and further relief the court deems necessary. She is represented by Matthew D. Pardy and Daniel P. Osterndorf of Pardy & Rodriguez PA in Orlando.
