ORLANDO — An assignee is suing ASI Assurance Corp. for alleged breach of contract.
Alron Construction LLC a/a/o Steve Butrimas filed a complaint on June 19 in the Ninth Judicial Circuit Court of Florida - Orange County, alleging that the defendant breached its duty of good faith and fair dealing.
According to the complaint, the plaintiff alleges that the home of the plaintiff’s assignor, Butrimas, was damaged by wind, hail and water on March 24, 2013, for which reimbursement for expenses was sought from the defendant. The defendant, however, allegedly refused and continues to refuse payment for all of the assignor's covered losses.
The plaintiff holds the defendant responsible for allegedly obligating the plaintiff to retain and pay for the services of a legal counsel to represent and protect its interest, and also for reportedly refusing to pay the full amount of the plaintiff's insurance claim.
The plaintiff requests a trial by jury and seeks judgment against the defendant for all covered losses with interest on any overdue payments, attorney's fees and costs. The plaintiff is represented by Katie S. Monroe of Hale, Hale & Jacobson PA in Orlando.
