Citizens Property Insurance Corporation accused of breach of contract

FORT LAUDERDALE — A homeowner is suing Citizens Property Insurance Corporation, citing alleged breach of contract.

Gilbert Canton filed a complaint on June 6 in the Broward County Circuit Court, alleging that the defendant breached its duty of good faith and fair dealing.

According to the complaint, the plaintiff alleges that he suffered covered losses and damages to his floor tiles on Oct. 1, 2015 after a water heater broke. Although, the plaintiff allegedly filed a timely claim, the defendant reportedly failed to provide the necessary reimbursement for covered losses. 

The plaintiff holds the defendant responsible for allegedly failing to timely evaluate and pay all benefits owed to him or comply with the terms of the insurance policy.

The plaintiff requests a trial by jury and seeks judgment against the defendant, declaratory relief, actual damages, interest, attorney's fees, costs incurred and further relief the court deems just. He is represented by Jose Selanikio of Gold Litigation PA in Hallandale Beach.
