Property owners allege that Universal Property and Casualty Insurance Co. failed to cover damages

FORT LAUDERDALE – The owners of an Oakland Park property allege their insurer has failed to cover damages to their home from a water loss.

Gunn Eva and Per Richard Ruud filed a complaint on May 23 in the 17th Judicial Circuit Court of Florida - Broward County against Universal Property & Casualty Insurance Co. alleging breach of contract.

According to the complaint, the plaintiffs allege that on Nov. 28, 2016, they sustained a loss on their property as a result of water damage. The suit states the defendant inspected the loss and on April 11, denied coverage alleging that it was not covered by the policy, but later agreed to provide coverage.

The plaintiffs hold Universal Property & Casualty Insurance Co. responsible because the defendant allegedly failed to acknowledge that payment would be forthcoming, and failed to make any payment of insurance proceeds.

The plaintiffs request a trial by jury and seek judgment against defendant for damages, interest, court costs, attorney's fees and further relief as the court deems just. They are represented by David Low of David Low & Associates PA in Fort Lauderdale.
