Lauderdale Lakes property owners seek declaratory relief in insurance despite

FORT LAUDERDALE – A couple is seeking the court's interpretation of an insurance policy regarding damages sustained to a property.

Fitzroy and Kathleen Anderson filed a complaint on May 19 in the 17th Judicial Circuit Court of Florida - Broward County against American Integrity Insurance Co. seeking declaratory relief and alleging breach of contract.

According to the complaint, the plaintiffs allege that on Oct. 10, 2016, while their Lauderdale Lakes property was insured under a homeowner's insurance policy, it sustained a loss. The suit states there is a dispute between the parties and the plaintiffs are seeking a declaration from the court regarding the existence and extent of their rights to coverage.

The plaintiffs request a trial by jury and seek judgment against defendant, actual damages incurred, interest, attorneys' fees, costs, and further relief deemed just. They are represented by Robert Delgado of Litigation & Recovery Law Center PL in North Miami Beach.
