Property owners allege University Property & Casualty failed to pay claim

ORLANDO – Two Orlando property owners allege that their insurer failed to pay for a covered loss to the property.

Olmer and Mary Boisseau filed a complaint on May 15 in the Orange County Circuit Court against Universal Property & Casualty Insurance Co. alleging breach of contract.

According to the complaint, the plaintiffs allege that on April 6, 2016, their Orlando property was damaged by a broken and/or leaking pipe. However, despite efforts of plaintiffs to furnished timely notice of covered loss and have performed all obligations precedent to recover under the policy, the defendant allegedly has yet to pay either part or all of plaintiffs' claim. 

The plaintiffs hold Universal Property & Casualty Insurance Co. responsible because the defendant allegedly failed to establish proof that it was not responsible for the payment of covered losses and failed to pay the requested amounts for repairs and/or replacements.

The plaintiffs request a trial by jury and seek judgment against the defendant for damages, interest, attorney's fees, costs, and other relief that the court deems proper. They are represented by Thomas J. Morgan Jr. of Morgan Law Group PA in Coral Gables.
