MIAMI – A woman formerly employed as a housekeeper alleges she was subjected to sexual harassment and was not paid overtime wages.
Nyrsa Demoya filed a complaint on Feb. 8 in the U.S. District Court for the Southern District of Florida against Kleen 1 LLC and Peter Buffa, alleging that the defendants violated the Fair Labor Standards Act and citing sex harassment and discrimination.
According to the complaint, the plaintiff alleges that she began working for the defendant as a housekeeper in January 2015 at the Town Plaza Condominium in Hallandale Beach. She alleges she failed to receive overtime compensation and was sexually harassed on a daily basis by a maintenance worker until she was terminated on Sept. 8, 2015.
The plaintiff holds Kleen 1 LLC and Buffa responsible because the defendants allegedly failed to pay overtime wages at a rate of time-and-one-half for each hour worked in excess of 40 hours per workweek, denied plaintiff job opportunities because of her sex and failed to provide remedial action to plaintiff's complaints of sexual harassment and discrimination.
The plaintiff requests a trial by jury and seeks judgment for all damages and relief, attorney's fees, costs and expenses, in addition to all other relief the court deems just and proper. She is represented by Chad E. Levy of Law Offices of Levy and Levy PA in Sunrise.
