FORT LAUDERDALE — A homeowner is suing Allstate Insurance Company, citing alleged breach of contract.
Maria Narvaez filed a complaint on April 26 in the Broward Circuit Court against Allstate alleging that the insurer breached its duty of good faith and fair dealing.
According to the complaint, the plaintiff alleges that, on Oct. 8, 2016, her insured property in St. Augustine sustained a covered loss for water damage, as well as molds and other damages. However, the amount of $7,472 issued by the defendant was insufficient to complete the repairs of all damages sustained by the plaintiff.
The plaintiff holds Allstate responsible because it allegedly obligated plaintiff to retain and pay for the services of a legal counsel to represent and protect her interest and refused to pay the full amount of plaintiff's insurance claim.
The plaintiff requests a trial by jury and seeks judgment against defendant for all damages, together with interest on overdue payments, attorney's fees, court costs and other relief deemed just. She is represented by Maria O'Donnell of The People's Law Team PA in Lighthouse Point.
