Homeowner claims Citizens Property Insurance didn't deny or pay claim

FORT LAUDERDALE – An insurance company is accused of neither denying nor paying a homeowner's claim for damages.

Edward Zito filed a complaint on April 25 in the 17th Judicial Circuit Court of Broward County against Citizens Property Insurance Corp. alleging breach of contract.

According to the complaint, the plaintiff alleges that on Sept. 11, 2016, his insured Plantation property sustained a covered loss for water damage due to a broken pipe and required necessary repairs and replacements, appropriate cleaning and other remedial measures. However, despite efforts of plaintiff to comply with all post-loss obligations, the defendant allegedly has yet to pay or deny the claim. 

The plaintiff requests a trial by jury and seeks judgment against defendant for damages, interest, attorney's fees, costs, and other relief that the court deems just. He is represented by Thomas J. Morgan Jr. of Morgan Law Group PA in Coral Gables.
