Transcriptionist claims Southern Transcription Services Inc. did not properly compensate for overtime work

FORT MYERS – A Collier County woman alleges she was not properly compensated for her work as a medical transcriptionist.

Ellen Cotter filed a complaint on April 18 in the U.S. District Court for the Middle District of Florida, Fort Myers Division against Southern Transcription Services Inc. and Hannah Brooks Morris alleging that the defendant violated the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that in December 2011, plaintiff was hired to work as a non-exempt employee for the defendant. Since the start of her employment through Nov. 6, 2016, plaintiff claims she worked in excess of 40 hours within a workweek.

The plaintiff holds Southern Transcription Services Inc. and Brooks Morris responsible because the defendant allegedly failed to properly compensate plaintiff at the statutory rate of one-and-one-half times her regular rate for all hours worked in excess of 40 hours per workweek as provided by the FLSA.

The plaintiff requests a trial by jury and seeks judgment for actual and liquidated damages, costs, expenses, attorneys' fees and such other relief deemed proper by the court. She is represented by Angeli Murthy of Morgan and Morgan PA in Plantation.
