CLEARWATER — A patient is suing St. Petersburg Kidney Care South LLC, a dialysis center, citing alleged negligence and vicarious liability.
Sadie Watkins filed a complaint on April 24 in the Pinellas Circuit Court alleging that the dialysis center breached its duty of good faith and fair dealing.
According to the complaint, the plaintiff alleges that she suffered a traumatic fall on March 13, 2015 that resulted in a leg fracture, surgery, cardiac complications and prolonged hospitalization. As a result of the alleged negligence of the nursing staff of the defendant in allowing the plaintiff to move from her wheelchair to a dialysis recliner without substantial assistance, despite familiarity with the patient's needs, which, according to her medical chart, required a patient lift or multiple persons to assist her for her risk of falling.
The plaintiff holds the defendant responsible for allegedly failing to take proper measures to prevent her from falling or utilize sufficient personnel or equipment such as a patient lift for the safe transfer of the plaintiff.
The plaintiff requests a trial by jury and seeks judgment against the defendant for damages in excess of $15,000, interest, costs and other relief to which she may be entitled. She is represented by Wil H. Florin and Eric P. Czelusta of Florin Roebig PA in Palm Harbor.
