Motorist alleges driver fell asleep, caused I-95 collision

ORLANDO – A Melbourne motorist alleges her vehicle was struck by another driver that fell asleep on Interstate 95.

Barbara Thomas filed a complaint on April 12 in the U.S. District Court for the Middle District of Florida, Orlando Division against United States of America, United Sates Army and Leonardo Alvarez Savageau alleging negligence.

According to the complaint, the plaintiff alleges that on Jan. 4, 2015, Savageau negligently operated the vehicle he was driving during the course of his active duty status for his co-defendant. The suit states he fell asleep while driving and collided with the vehicle plaintiff was in. The plaintiff alleges that she sustained bodily injury, suffered physical handicap, impaired working ability, incurred medical expenses and suffered property damage.

The plaintiff holds United States of America, United Sates Army and Savageau responsible because Savageau was allegedly negligent in failing to exercise a degree of care and caution.

The plaintiff requests a trial by jury and seeks judgment against defendant for damages, costs, attorney's fees and other relief that is just and proper. She is represented by Paul E. Bross of Bross, Bross, Thomas & Savy LLC in Merritt Island.
