Dockside Investors VII, BDC Investors II claim damages from allegedly defective system design

CLEARWATER – A Florida consulting company and a civil engineer are alleged to have designed a defective storm water management system.

Dockside Investors VII LLC and BDC Investors II LLC filed a complaint on April 13 in the 6th Judicial Circuit Court of Florida - Pinellas County against Gulf Coast Consulting Inc. and Sean P. Cashen PE alleging breach of contract and professional malpractice.

According to the complaint, the plaintiffs allege that on June 20, 2013, they contracted with the defendants to prepare construction drawings and plans for a site development project, including a storm water management system that was later found to be defective and deficient. As a result, plaintiff alleges it sustained damages, incurred additional expenses, and loss of construction space. 

The plaintiffs request a trial by jury and seek judgment against defendants for compensatory damages, prejudgment interest, attorney's fees, costs of suit, and further relief as the court deems just. It is represented by Luis Prats and J. Derek Kantaskas of Carlton Fields Jorden Burt PA in Tampa.
