MIAMI – A paraplegic alleges he visited a Miami business to inquire about a vehicle but encountered barriers there.
Renzo Barberi filed a complaint on April 4 in the U.S. District Court for the Southern District of Florida against Rubio Auto Sales Corp., Rafael Rubio and Miriam Rubio citing the Americans with Disabilities Act.
According to the complaint, the plaintiff uses a wheelchair and visited the defendants' property in Miami and alleges he was denied full and equal access to the property because of architectural barriers. The plaintiff holds Rubio Auto Sales Corp., Rafael Rubio and Miriam Rubio responsible because the defendants allegedly have an accessible parking space that is currently non-compliant and does not have accessible routes on the property.
The plaintiff seeks judgment against the defendants, injunctive and declaratory relief, award of attorney's fees, costs, expert fees, other expenses of suit and further relief as the court deems necessary. He is represented by Ronald E. Stern of The Advocacy Law Firm PA in Hallandale Beach.
