MIAMI – A Palm Beach County consumer alleges a debt collector is attempting to collect a debt she does not owe.
Mildred Moore filed a complaint on April 3 in the U.S. District Court for the Southern District of Florida against Larry T. Costez and Wyant-Costez and Costez Chartered alleging that they violated the Florida Consumer Collection Practices Act and the Fair Debt Collection Practices Act.
According to the complaint, the plaintiff alleges that on Aug. 29, 2016, she received the initial debt collection communication from defendant concerning an alleged debt. The plaintiff holds Larry T. Costez and Wyant-Costez and Costez Chartered responsible because the defendants allegedly artificially and illegally created a debt that the plaintiff did not owe and proceeded to improperly charge late fees, interest, costs and attorney’s fees.
The plaintiff requests a trial by jury and seeks statutory and punitive damages, an accounting of her payments and a refund on any amounts due to her from overpayments and such other and further relief that the court deems appropriate.
