Man alleges Bermudiana Plaza has barriers that restrict access to disabled

MIAMI – A disabled man who uses a wheelchair alleges that a shopping plaza has barriers that restricted his ability to visit the property.

David Poschmann filed a complaint on March 28 in the U.S. District Court for the Southern District of Florida against Bermudiana Condominium Association Inc., Bermudiana LLC and CC & SEG Inc. citing the Americans with Disabilities Act.

According to the complaint, the plaintiff alleges that he visited the defendants' Bermudiana Plaza but was denied access to full enjoyment of the accommodations there because of architectural barriers. The plaintiff holds Bermudiana Condominium Association Inc., Bermudiana LLC and CC & SEG Inc. responsible because the defendants' property allegedly has noncompliant parking spaces and doors.

The plaintiff seeks judgment against defendants, permanent injunction, attorney's fees, litigation expenses, expert fees and costs. He is represented by Drew M. Levitt and Lee D. Sarkin of Law Office of Drew M. Levitt in Boca Raton.
