MIAMI – A Broward County consumer has filed a class action against a debt collector over allegations of unlawful fees.
Anita Jairam filed a complaint on behalf of herself and all others similarly situated on April 2 in the U.S. District Court for the Southern District of Florida against Retrieval-Masters Creditors Bureau Inc., doing business as Medical Collection Agency, alleging violation of the Fair Debt Collection Practices Act.
According to the complaint, the plaintiff alleges that she made a payment to the defendant on a consumer debt and was charged a $4.95 convenience fee because she paid with a card. The plaintiff holds Retrieval-Masters Creditors Bureau Inc. responsible because the fee is allegedly in violation of the FDCPA.
The plaintiff requests a trial by jury and seeks judgment against defendant, order certifying collective action, statutory and actual damages, costs, attorneys' fees, and further relief as this court may deem appropriate.
