Consumer accuses debt collector of false, deceptive communication

MIAMI – A Palm Beach County resident claims a debt collector filed an invalid claim of lien against his home.

Robert Warshaw filed a complaint on March 28 in the U.S. District Court for the Southern District of Florida against Scott J. Wortman and Korte & Wortman PA citing the Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges that on Aug. 23, 2016, he sustained damages from receiving an initial communication from the defendant regarding an alleged homeowner's association (HOA) debt. However, he alleges the collection communication was false, invalid, deceptive and misleading, as the defendants sought to collect large amounts that are against the law and that the plaintiff did not owe. He also claims the defendants filed a defective, invalid and fraudulent claim of lien against his homestead.

The plaintiff requests a trial by jury and seeks judgment against defendants, statutory damages, actual damages of $7,143, refund all payments, attorney's fees, costs, interest, and further relief that the court deems appropriate.
