Woman seeks reinstatement to disability benefits from Life Insurance Co. of North America

MIAMI – A former process technician for the Musculoskeletal Transplant Foundation alleges her disability benefits were unlawfully terminated.

Mehnoor Zaidi filed a complaint on March 28 in the U.S. District Court for the Southern District of Florida against Life Insurance Co. of North America alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges she filed a claim with the defendant in October 2013 for disability benefits, which was approved. The suit states her benefits were terminated in May 2016.

The plaintiff holds Life Insurance Co. of North America responsible because the defendant allegedly failed to pay disability benefit payments to plaintiff, failed to describe to plaintiff any additional material or information necessary to perfect her claim, and failed to provide a full and fair review of plaintiff’s claim.

The plaintiff seeks judgment against defendant, benefits due, costs, attorneys’ fees, interest, and further relief as the court deems just. She is represented by Cesar Gavidia of Attorneys Dell and Schaefer, Chartered in Hollywood.
