MIAMI – A Hollywood woman has filed a class-action suit against a Coral Gables debt collector.
Tamyka M. Lee filed a complaint on behalf of herself and all others similarly situated on March 27 in the U.S. District Court for the Southern District of Florida against Pollack & Rosen PA and Joseph F. Rosen alleging violation of the Fair Debt Collection Practice Act.
According to the complaint, the plaintiff received a debt collection letter from the defendants that did not include a statement that if the consumer notifies the debt collector in writing within the 30-day period that the debt is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector. The plaintiff alleges this is a violation of the FDCPA.
The plaintiff requests a trial by jury and seek judgment in favor of plaintiffs, certify class action, statutory damages, attorney's fees, litigation expenses, costs of suit, and further relief as the court deems just.
