Man files suit against Coral Springs, officer alleging excessive use of force

FORT LAUDERDALE – A man alleges he needed additional treatment for an injury because of the actions of police officers.

Scott T. Bickel filed a complaint on March 27 in the U.S. District Court for the Southern District of Florida against the city of Coral Springs and Jason Carter alleging excessive use of force, assault and/or battery, intentional infliction of emotional distress and other counts.

According to the complaint, the plaintiff alleges that on Sept. 6, 2013, officers arrived at his house because of an argument between his son and son-in-law that caused neighbors to contact the police. He alleges he had just had surgery and that his arm was injured, and informed the officers of such, but they allegedly forced his hands behind his back to place him in handcuffs. He also alleges Carter "slammed" his head into the concrete. He alleges he needed additional surgery and medical treatment for his arm because of the damage.

The plaintiff holds the city of Coral Springs and Carter responsible because the defendants allegedly retaliated against citizen's who assert their constitutional rights, allowed for deficient policy, practice and/or custom, and failed to take appropriate action to retrain, discipline, and supervise its agents.

The plaintiff seeks judgment against defendants for all compensatory and punitive damages incurred, attorney’s fees, costs, and such other relief that the court deems just. He is represented by David A. Frankel of Law Offices of David A. Frankel PA in Fort Lauderdale.
