FORT LAUDERDALE – A Palm Beach County woman claims that a Pompano Beach business does not have an accessible restroom for the disabled.
Janet Hoyt filed a complaint on March 23 in the U.S. District Court for the Southern District of Florida, Fort Lauderdale Division against PCL Enterprise Corp., doing business as Floors To Go, alleging violation of the Americans with Disabilities Act.
According to the complaint, the plaintiff alleges that she visited the defendant's property on Feb. 15 and was denied full and equal access and enjoyment of the facilities, services, goods and amenities within the premises. The plaintiff holds PCL Enterprise Corp. responsible because the defendant allegedly failed to properly install fixtures in the unisex restroom, such as the grab bar, soap dispenser and water closet, failed to design and construct such premises to be accessible to and accommodate persons with disabilities.
The plaintiff seeks judgment against defendant, injunctive and declaratory relief, attorneys' fees, all costs, and further relief as it may deem necessary. She is represented by Jason S. Weiss and Zachary W. Smith of Weiss Law Group PA in Coral Springs.
