ORLANDO – A Marion County man alleges his former concrete, block and bricks contractor employer did not pay him overtime wages.

Casey Lofton filed a complaint on March 9 in the U.S. District Court for the Middle District of Florida against LL & J Concrete Inc. and Levi N. West alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that between Feb. 16, 2015, and Sept. 29, 2016, he worked 45 hours per week but was never paid the extra half time overtime rate. As a result, he alleges he has suffered accrued damages for unpaid overtime wages of $5,040. The plaintiff holds LL & J Concrete Inc. and West responsible because the defendants allegedly willfully refused to pay wages owed to plaintiff.

The plaintiff requests a trial by jury and seeks costs, attorney's fees and all other remedy as the court deems just and proper. He is represented by James M. Loren of Goldberg & Loren PA in Plantation.
