MIAMI – A Palm Harbor limited liability company claims a Nevada corporation is using marks that are similar to its own.
Wealth Off Wall Street LLC filed a complaint on March 7 in the U.S. District Court for the Southern District of Florida against Live Out Loud Inc. and Loral Langemeier alleging copyright and trademark infringement, cyber piracy and other counts.
According to the complaint, the plaintiff alleges that it suffered damages to its company from having its Wealth Off Wall Street (WOWS) mark used. The plaintiff holds Live Out Loud Inc. and Langemeier responsible because the defendants' OWSW mark is confusingly similar to the plaintiff's WOWS mark and the defendants' domain name is similar to the plaintiff's.
The plaintiff requests a trial by jury and seeks order the destruction of all infringing works, actual damages, pay profits to the plaintiff, all damages, treble damages, exemplary, punitive damages, all legal fees and any other relief as the court deems just.
