Women seeks reinstatement of benefits from Aetna Life Insurance Co.

MIAMI – A Bank of America Corp. employee is seeking reinstatement of her disability benefits.

Arlinda Rodrigues filed a complaint on March 6 in the U.S. District Court for the Southern District of Florida against Bank of America Corp. and Aetna Life Insurance Co. citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that in 2015, she became disabled and was initially approved to receive short-term disability benefits until the short-term benefits were terminated and her claim for long-term disability benefits were in 2016. The plaintiff holds Bank of America Corp. and Aetna Life Insurance Co. responsible because the defendants allegedly upheld their decision to deny further payments to the plaintiff despite still being disabled according to the terms of the plan.

The plaintiff seeks payment of disability benefits due to the plaintiff, reinstatement, all legal fees, interest, and any other relief as the court deems just. She is represented by Victor Pena and Gregory Michael Dell of Attorneys Dell and Schaefer, Chartered in Hollywood.
