Sun Life Assurance Co. of Canada accused of breach of contract over benefit denial

FORT LAUDERDALE – A Broward County man alleges that his disability benefits were wrongfully terminated.

Samuel M. Barbakoff filed a complaint on Feb. 27 in the U.S. District Court for the Southern District of Florida, Fort Lauderdale Division against Sun Life Assurance Co. of Canada alleging breach of contract.

According to the complaint, the plaintiff alleges that in March 2014, he became disabled and was initially approved for disability benefits until his claim was terminated in June 2016. The suit states he appealed the decision in October 2016. The plaintiff holds Sun Life Assurance Co. of Canada responsible because the defendant allegedly has failed to provide any final determination on the plaintiff's appeal.

The plaintiff seeks payment of all plan benefits, interest, all legal fees and any other relief as the court deems just. He is represented by Nick A. Ortiz of Ortiz Law Firm in Pensacola.
