Nationstar Mortgage alleged to have violated Real Estate Settlement Procedures Act

FORT LAUDERDALE – A Broward County property owner alleges a loan company did not timely respond to his request for information.

Carlos J. Renzo filed a complaint on Feb. 21 in the U.S. District Court for the Southern District of Florida against Nationstar Mortgage LLC citing the Real Estate Settlement Procedures Act.

According to the complaint, the plaintiff alleges that on Aug. 16, 2012, he suffered damages from a foreclosure action on his property. Consequently, the suit states plaintiff's counsel prepared and mailed to the defendant a written request for information (RFI) in December 2016 to explain the charges the defendant claimed as due on plaintiff's account. The plaintiff holds Nationstar Mortgage LLC responsible because the defendant allegedly failed to provide plaintiff with a timely acknowledgement of the RFI, and failed to respond to the specific inquiries made in the RFI.

The plaintiff requests a trial by jury and seeks judgment against defendant, for the defendant provide the information, actual damages, statutory damages, costs, attorney’s fees, and other relief to which the court may deem just. He is represented by Michael A. Citron, Matthew Yerachmiel and David Bavaro of Loan Lawyers LLC in Fort Lauderdale.
